THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND. TO THE FULLEST EXTENT PERMITTED BY LAW, Delicatetia Manila DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, Delicatetia Manila SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICES, EVEN IF Delicatetia Manila HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR AGGREGATE LIABILITY FOR DIRECT DAMAGES SHALL NOT EXCEED THE AMOUNTS YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE EVENT GIVING RISE TO LIABILITY.

10. Indemnification

You agree to indemnify and hold Delicatetia Manila and its officers, directors, employees, and agents harmless from any claims, liabilities, damages, losses and expenses (including reasonable attorneys' fees) arising out of your breach of these Terms or your violation of applicable law.

11. Termination

We may suspend or terminate your access to the Services at any time for any reason, including breach of these Terms or where required by law. Upon termination, your right to use the Services will immediately cease.

These Terms are governed by the laws of the Republic of the Philippines, without regard to its conflict of laws principles. You agree to the exclusive jurisdiction of the courts located in the Philippines for any dispute arising out of or relating to these Terms.
